As per CNN, the plaintiff has also filed a lawsuit against the restaurant’s parent company, Catch Hospitality Group, and their affiliated businesses, claiming negligence in their hiring, training, and supervision practices to ensure security.
Foxx’s spokesperson stated CNN,
“The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then.–We are confident they will be dismissed again. And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”
The situation allegedly took place when a friend of the plaintiff requested a photo from Foxx. According to the lawsuit, Foxx appeared to be intoxicated and remarked that the plaintiff resembled Gabrielle Union, praising her physique as that of a supermodel, and further escalated from that point.
